Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Munchit mobile application and website (collectively, the "Service") operated by Munchit ("we", "our", or "us"). By downloading, installing, or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, logging a meal, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy, which is incorporated by reference. We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the revised Terms.

2. Eligibility

The Service is intended for users aged 13 and older. By using the Service you represent that you are at least 13 years of age. If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

Munchit is a nutrition and calorie tracking application. Its core features include:

• Voice and text-based meal logging with AI-generated nutritional estimates.
• Weight, hydration, and progress tracking.
• Personalised AI health insights based on your logged data.
• Optional social leaderboard and friend streak comparisons.
• Optional integration with Apple HealthKit (iOS).

4. AI & Nutrition Disclaimer

Munchit uses artificial intelligence to estimate nutritional content and to generate personalised health insights. All estimates, recommendations, and insights provided by the Service are approximations for informational purposes only and are not medical, dietary, or professional health advice. Nutritional estimates may vary from actual values due to differences in preparation, portion size, and ingredient variation.

You should not rely on the Service as a substitute for professional medical or dietary advice. Always consult a qualified healthcare provider before making significant changes to your diet, exercise routine, or lifestyle — particularly if you have or suspect any medical condition.

Munchit does not guarantee the accuracy, completeness, or suitability of any nutritional estimate or health insight for your individual circumstances.

5. Third-Party AI Processing

To provide nutritional estimates and personalised insights, the Service transmits certain data to a third-party AI provider. This data may include your meal descriptions, voice transcripts, photos, profile and biometric information (age, gender, height, weight, BMI, activity level, goals), and summaries of your logged meals, hydration, and — where you have granted permission — HealthKit activity data.

Before any data is sent to the AI provider, the app presents a clear in-app disclosure and you must take an affirmative action (sending your first entry) to consent. You may withdraw this consent at any time by deleting your account (Settings → Delete Account) or by contacting us at hello@munchit.ai.

Our third-party AI provider is contractually prohibited from using your data to train its models and is required to provide the same level of data protection described in our Privacy Policy. We do not sell your data to third parties.

6. User Content

You retain ownership of the content you submit to the Service, including meal descriptions, photos, and weight entries ("User Content"). By submitting User Content, you grant Munchit a limited, non-exclusive licence to store, process, and transmit that content as necessary to provide the Service (including transmission to our AI provider as described above). We do not use your User Content for advertising purposes.

You are responsible for ensuring that any User Content you submit does not violate applicable laws or third-party rights.

7. Subscriptions and Billing

Munchit offers a 7-day free trial followed by an auto-renewing subscription. Subscription details:

• Trial: The 7-day free trial begins when you start it in the app. After the trial period, your subscription will auto-renew at the applicable rate unless cancelled at least 24 hours before the end of the trial.
• Billing: Subscriptions are billed through Apple's App Store or Google Play. Your payment method is charged at confirmation of purchase and at renewal.
• Cancellation: You may cancel at any time via your device's subscription management settings (App Store → your Apple ID → Subscriptions, or Google Play → Subscriptions). Cancellation takes effect at the end of the current billing period; no refunds are issued for unused time except as required by law.
• Restore Purchases: To restore a prior subscription on a new device, use Settings → Restore Purchases in the app.
• Price changes: We will notify you of any price change before it takes effect.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, decompile, or extract source code from the app.
• Use automated tools to scrape, crawl, or extract data from the Service.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Misrepresent your identity or affiliation with any person or entity.
• Upload content that is harmful, offensive, or infringes any third-party rights.

9. Intellectual Property

The Service, including its design, text, graphics, logos, software, and AI models, is owned by Munchit and protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, trade names, or branding without our prior written consent.

10. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, Munchit and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Munchit and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we reasonably believe your use poses a risk to us or other users. You may delete your account at any time via Settings → Delete Account. Upon termination, your licence to use the Service ceases immediately.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection law grants you additional rights in your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. For material changes, we will notify you by email or a prominent notice within the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
